Ruta del dinero K: la Justicia confirmó que deberá continuar la investigación sobre Cristina Kirchner
La Cámara Federal de Casación Penal dictó un nuevo fallo en el caso de la Ruta del dinero K, vinculando a la expresidenta Cristina Kirchner con la fortuna del empresario Lázaro Báez, condenado a 10 años de prisión por lavado de dinero.
El tribunal, compuesto por los jueces Gustavo Hornos y Javier Carbajo, con la disidencia de Mariano Borinsky, rechazó un recurso presentado por la defensa de Cristina Kirchner. La decisión obliga al juez federal Sebastián Casanello a reconsiderar la situación procesal de la exmandataria.
Borinsky ya se había pronunciado anteriormente en esta causa en disidencia, cuando propuso abrir el recurso para analizar si correspondía o no actuar a la asociación Bases Republicanas como querellante particular ante la defección del fiscal Guillermo Marijuan.
Por su parte, Hornos y Carbajo argumentaron que “la vía intentada por la parte recurrente resulta improcedente en tanto las decisiones atacadas no encuadran dentro de las previsiones del artículo 457 del Código Procesal Penal de la Nación, en la medida en que no se trata de una sentencia definitiva o equivalente”.
En esta línea, los magistrados señalaron que Cristina Kirchner no “alcanzó a demostrar que la resolución cuestionada produzca al impugnante un agravio de tardía o imposible reparación ulterior” ni se acreditó “la existencia de una cuestión federal que permita habilitar la competencia” de la Casación. Por lo tanto, se rechazó el recurso con costas.
En tanto, Borinsky dijo que “la queja en estudio fue deducida en debido tiempo y forma por quien se encuentra legitimado para ello” y que “la naturaleza federal del agravio planteado por la recurrente, el cual luce, en principio, razonablemente fundado como así también la demostración del agravio actual de tardía o imposible reparación ulterior que le generan, permite equiparar la resolución atacada a un pronunciamiento de carácter definitivo y habilitar así esta instancia”. Sin embargo, su pedido no prosperó.
El camino para llegar a esta sentencia fue largo y sinuoso. El fiscal Marijuan, que había imputado a Cristina Kirchner luego de una investigación de mas de 10 años, promovió su sobreseimiento al concluir que no había vínculos entre la exmandataria y el lavado de Báez, quien acumuló una fortuna valuada en 200 millones de dólares.
Ese dictamen de Marijuan, que llevaba al cierre de la causa contra Cristina Kirchner, fue presentado el 24 de mayo del año pasado. De esta manera, sin acusación fiscal, la causa estaba destinada a morir. Sin embargo, el caso tomó un giro cuando la ONG Bases Republicanas, integrada por allegados al PRO, logró ser admitida como querellante en la causa.
Con la firma de los jueces Mariano Llorens y Pablo Bertuzzi, la Cámara Federal aceptó a la asociación en ese carácter y revocó el sobreseimiento de Cristina Kirchner, “debiendo el juez a quo [Casanello] volver a expedirse”. En respuesta, la defensa planteó un recurso de queja que hasta ahora fue rechazado por la Cámara de Casación.
El juez Llorens había cuestionado con dureza el dictamen de Marijuan, asegurando que “aparece solo como una evaluación parcial y sesgada de elementos aislados del proceso”. En este sentido, reclamó una “evaluación integral” del rol de Cristina Kirchner que contemple, por ejemplo, las acusaciones del caso Vialidad “que dan cuenta de la relación entre Lázaro Báez y Cristina Fernández de Kirchner”, de sus “negocios en común”, y de “los beneficios mutuos que esa relación tuvo y podría llegar a seguir teniendo”.
Marijuan había dicho en su dictamen: “Aún con la claridad de esa vinculación de Lázaro Báez con Cristina Elizabeth Fernández, habiendo transcurrido más de diez años desde el inicio de este proceso penal y casi cinco desde la declaración indagatoria de la nombrada en el marco de este expediente, no he logrado reunir elementos probatorios que me lleven a avanzar más allá del estado de sospecha y avanzar a otro estadio procesal -el juicio- como sucediera con sus hasta aquí consortes de causa”.
De acuerdo a Llorens, esta afirmación prueba que la fiscalía “ha dado un trato desigual a aquellos a quienes trata como iguales”.
